Sometimes, before or during a marriage, an individual wants to protect his or her assets and income from the claims of a future or current spouse. Under these circumstances, we will negotiate and prepare a Pre- or Post-Nuptial Agreement.
When representing the party who is safeguarding assets or income, we will make recommendations and negotiate an agreement that attempts to protect our client to the greatest extent possible, while still being fair to the future or current spouse.
When representing the party who is being asked to sign a Pre- or Post-Nuptial Agreement, we first explain to the client his or her rights and obligations under the potential contract and then discuss the rights and obligations that would exist if the agreement is not signed. We then try to negotiate the best possible agreement for our client, with the goal being to obtain as much financial security as possible for our client.
We have many years of preparing hundreds of prenuptial agreements. Usually, we will work alone with our client, but sometimes we work with an estate planning and/or tax attorney when the financial issues are highly complicated and involve sophisticated estate and tax planning.
