In those cases where either our client or the other party chooses not to use the Collaborative Process or the other attorney is not trained in the Collaborative Process, we can still help our client negotiate a settlement without having to litigate. In such circumstances, we will urge the other attorney to voluntarily exchange all necessary documents and to resolve disputes, rather than asking a judge to resolve the disputes for the couple. However, using such direct negotiations does not include a formal commitment from the other party, so we have no way to guaranty that merely negotiating a settlement will not result in litigation. But in some cases, this is the best alternative to litigation that our client can achieve.
