About us

We find solutions
We facilitate settlement.

At The Law Offices of Robert J. Merlin, P.A., we are passionate about helping our clients successfully resolve their cases and favorably position them for the future. Through compassionate understanding, education, and a focus on out-of-court settlements, Robert J. Merlin and his associate and staff help guide clients through the complex areas of family law and divorce.

Our firm offers services in all areas related to divorce, including time-sharing of children, parenting plans, child support, alimony, the equitable distribution of assets and liabilities, and the preparation and negotiation of pre- and post-nuptial agreements, cohabitation agreements and settlement agreements. We also provide mediation services to help couples negotiate the settlement of their differences.

No matter which method our client chooses, our goal is to resolve disputes as expeditiously and as economically as possible, while always focusing on our client’s best interests.

Robert J. Merlin is experienced in several methods of dispute resolution – Collaborative Law, mediation, direct negotiations, and litigation. Bob is a Florida Bar Board Certified Family Law Specialist, a Florida Supreme Court Certified Family Mediator and has received special training in the Collaborative Law Process.

As a general philosophy, we believe that clients benefit most when they are able to resolve their disputes without court intervention. In fact, more than 90% of divorces settle before trial. The question is which method will best achieve the desired results. We will always attempt to reach a settlement on behalf of our client through Collaborative Law, negotiation or mediation, to try to minimize the costs of the divorce process, both emotional and financial.

Our experience in family law enables us to bring problem-solving skills to each case. We brainstorm with clients and offer both sides creative alternatives, sometimes suggesting options that no one else thought of but that will serve everyone’s best interests. Also, Bob draws on his education and background in accounting and his many years of experience to understand financial issues and help resolve those issues in ways that provide long-term value to clients.
the majority of family attorneys cannot.

We Do Not Litigate.

We no longer accept cases that are going to be litigated and feel that litigation should be a last resort for families. The litigation process can be so destructive, expensive and time-consuming that we choose to serve our clients with more positive, constructive approaches. The attorneys of Robert J. Merlin, P.A. have the skills to help our clients resolve their cases outside of court without going to battle with their spouse or the other parent of their child. We strongly believe that avoiding the stress of litigation is in the best interests of our clients, especially when children are involved.

How we work with clients.

We welcome prospective clients to meet with us during an initial consultation, for which there is a reasonable charge. We will spend between one and two hours discussing the facts of the case, the applicable law, the parties’ rights and obligations, the different processes that are available and our recommendations for a course of action. At that time, we will also discuss the anticipated cost of our representation and our fee arrangement. If the client and we jointly decide to proceed with our representation, we will enter into a formal retainer agreement that sets forth the financial terms of our employment.

Leaders in Collaborative Law.

The recognition that a marriage is irretrievably broken is painful enough for many couples. They do not wish to add to each other’s suffering, or that of their children, in the divorce process. Rather than expending valuable financial and emotional resources by prolonging the conflict, they want to move forward with their individual lives, establish effective co-parenting relationships, and preserve as many of their assets as possible. Collaborative Law was made for families like these. It is also why we at Robert J. Merlin, P.A. have made the commitment to being leaders in the practice of Collaborative Family Law in Florida.

Bob Merlin is one of the most experienced Collaborative Law attorneys in Florida, and he uses the Collaborative Process to help clients with a wide range of family issues, including the negotiation of Prenuptial Agreements. His dedication to ongoing training has made him the “go-to” resource for other Collaborative professionals in Florida and other states. Clients who work with Bob as their Collaborative lawyer gain the benefits of his considerable expertise in this humane, problem-solving, and non-adversarial way of divorcing. When they reach a settlement, they will likely feel better off emotionally and financially than if they had made a different choice.
